Whatever path we take from here, the worst of any path would heavily favor one group over the other. Repeal does exactly that. Placing your signature on the petition now being circulated by a "housing provider" faction group will be one step closer to completely ignoring tenants in favor of the wishes of the landlords. Read why on the PDFs below. Other property owners and the creatures of folklore are left confused.
We ought to be able to change specific phrases in the 2022 ordinances and be considerate of all stakeholders, without sending Fairfax back to the days of robber barons. The Town has already proposed a workshop as a step toward recrafting the ordinances as fair to landlords, tenants, property owners and creatures of folklore. In effect, the workshop step, and any steps to follow, are the appeal process at the behest of the landlord group and its resident sympathizers, without special interest influencers from outside Fairfax.

REMEMBER: The "housing providers" faction group has already been pitching that the only way to “fix” what voters might fear about the rental protection ordinances is to repeal them. They will point out the worst of the current ordinance without offering specific solutions to these same "worst" conditions. The specific solutions are exactly what the town would address as a top priority during the workshop appeal process.
By the time a ballot measure goes to a vote, the ordinances will not look the same as they do now – that is if we work as a community to refine them.
BUT, a ballot measure would still repeal any improved ordinances irrespective of their content and a ballot measure will invite big money influencers from outside of Fairfax to attempt to conform Fairfax to the will of outside robber barons.

Superior quality is desirable. Desirability drives value. The absence of quality results in a substandard investment. Some smaller rental property types such as ADUs are exempt from the California Tenant Protection Act of 2019. Neither owners nor tenants can enjoy the benefits of a highest quality neighborhood if a community relies heavily on exempted dwelling units to satisfy its housing needs. An investment in any – every - home in such a community will suffer should that community throw quality into the wind for whatever reason. Think of "tenant protections" or "rental protections" as though they were a form, an endorsement, of a virtual insurance policy.
If there are two rental dwellings identical in every other way except, one has tenant protection for its occupant and one does not. Which dwelling is substandard?
a. The dwelling with occupant protection
b. The dwelling without occupant protection
If a community relies on dwellings exempt from tenant protections to meet its housing needs, is the community policy encouraging substandard neighborhoods?
a. Yes, the community’s policy does encourage substandard housing.
b. No, the community’s policy does not encourage substandard housing.
Which community would have higher quality?
a. A community with substandard housing.
b. A community without substandard housing.
Which income property would be a better investment?
a. An investment in a community with higher quality.
b. An investment in a community which has subpar quality.
The "Keep Fairfax Fair Act" title was deemed inappropriate.
This ordinance would also be repealed by the ballot initiative.
This is the only ordinance to be restored if the ballot initiative passed. Note a retaliatory eviction can still take place initiated by a landlord if this ordinance is not paired with a for-cause ordinance.
